Terms and Conditions

1. Introduction

Welcome to BHI Gardening (“we,” “our,” “us”). By accessing or using our website https://bhigardening.co.uk and our gardening and landscaping services (“Services”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree with any part of these Terms, please do not use our Services.

2. Services

We offer a range of gardening and landscaping services, including but not limited to:

  • Flower Bed Installation and Care
  • Hedge Trimming
  • Jet Washing
  • Lawn Mowing
  • Lawn Care
  • Landscape Design and Installation
  • Planting

3. Quotations and Contracts

3.1 Quotations: Upon request, we will provide a written quotation for the Services you require. This quotation is valid for 30 days from the date of issue.

3.2 Acceptance: By accepting our quotation, either verbally or in writing, you enter into a contract with us under these Terms.

3.3 Changes: Any changes to the scope of work after acceptance may result in adjustments to the price and completion timeline. Such changes must be agreed upon in writing.

4. Payment Terms

4.1 Deposit: A non-refundable deposit of 20% of the total quoted price is required to secure your booking. This deposit will be deducted from the final invoice.

4.2 Payment Schedule: For projects exceeding £1,000 in labour costs, a 50% payment is due upon commencement of work, with the remaining balance payable upon completion.

4.3 Methods: Payments can be made via bank transfer or cash. All invoices are due upon receipt unless otherwise agreed in writing.

4.4 Late Payments: Payments not received within 7 days of the due date may incur interest at 8% above the Bank of England base rate, compounded monthly until full payment is made.

5. Client Responsibilities

5.1 Access: You agree to provide us with reasonable access to your property during agreed working hours and ensure the work area is free from hazards.

5.2 Utilities: Access to water and electricity is required for certain Services. You agree to provide these utilities at no additional cost to us.

5.3 Permissions: It is your responsibility to obtain any necessary permissions, licenses, or consents required for the work to be carried out.

6. Cancellations and Rescheduling

6.1 By Client: Cancellations or rescheduling requests must be made at least 48 hours before the scheduled start time. Cancellations made within 48 hours may incur a fee of 100% of the quoted price.

6.2 By Us: We reserve the right to cancel or reschedule Services due to unforeseen circumstances such as adverse weather conditions or staff illness. In such cases, we will notify you as soon as possible to arrange an alternative date.

7. Materials and Plants

7.1 Supply: All materials and plants supplied by us remain our property until full payment is received.

7.2 Quality: We take care to source quality materials and plants. However, we cannot guarantee the longevity of living plants once they have been installed, as their survival depends on proper care and environmental conditions.

8. Liability

8.1 Damage: We will take all reasonable precautions to avoid damage to your property. However, we are not liable for pre-existing faults or damage or for any damage caused by third parties.

8.2 Insurance: We hold Public Liability Insurance up to £2,500,000.

9. Complaints and Dispute Resolution

9.1 Complaints: Any complaints should be raised in writing within 7 days of the completion of the Services. We will address your concerns promptly and aim to resolve them within 14 days.

9.2 Disputes: In the event of a dispute that cannot be resolved amicably, both parties agree to consider mediation before pursuing legal action.

10. Privacy and Data Protection

We are committed to protecting your privacy. Any personal information collected will be used solely for the purpose of providing our Services and will not be shared with third parties without your consent. For more details, please refer to our Privacy Policy.

11. Amendments

We reserve the right to amend these Terms at any time. Any changes will be posted on our website and will take effect immediately upon posting.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
